VILLAGE OF DECATUR REGULAR BOARD MEETING August 12th, 2021 @ 4:30 P.M. NOTE: Everyone must use the microphones at the table. The audience must be quiet during the meeting. If you want to ask a question and you are not on the agenda, you must raise your hand, get permission from the Chairman, and come to the microphone before speaking. If you are on the agenda the same rule applies. THE VILLAGE BOARD HAS THE RIGHT TO MODIFY THE AGENDA AT THE REGULAR MEETING WHEN CONVENED. MEETING IS OPEN TO THE PUBLIC. A COPY OF THE OPEN MEETINGS ACT IS LOCATED ON THE NORTH WALL. Guest signing in were: Guests not signing in were: Chad Carrier, Tim Slaughter, Rod Nelson. Guests not signing in were Ruvan King, Officer Brittany Hedlund, Dave from Stabuilt Construction. 1) REGULAR MEETING CALLED TO ORDER BY CHAIRMAN SIECKE: Roll Call: Hightree-yes, Klatt-yes, Siecke-yes, Troutman-yes, Warren-yes. Quorum Present-yes 2) EXCUSE BOARD MEMBERS NOT ATTENDING THE MEETING: All were present. 3) AGENDA AND MINUTES OF THE PREVIOUS MONTH'S MEETING RECEIVED: Roll Call: Hightree-yes, Klatt-yes, Siecke-yes, Troutman-yes, Warren-yes. 4) APPROVAL AND/OR CORRECTION AND SUSPENDED READING OF THE PREVIOUS MONTH MINUTES: There were no corrections. Roll Call: Hightree-yes, Klatt-yes, Siecke-yes, Troutman-yes, Warren-yes. 5) REPORTS OF OFFICERS, BOARDS AND OR COMMITTEES: 1. Police: Monthly Report – No Police Report 2. Lights: Monthly Report- No meters pulled. Prices for new poly cutouts is $74.94 without arrestors and $135.97 with arrestors from Border States. The price for Burt County Public Power to install them is $155.00 for each one and there is a total of 200. Troutman asked if we had to have arrestors? Hightree stated we do need arrestors. Hightree is working on getting another bid for installing. Klatt asked why we were not going with breakers? Hightree stated that they are very expensive. The board discussed replacing the arrestors on the east side of town first because it seems to have the most problems, and do the west side of town next budget year. Hightree asked if the board was in agreement to pull electric meters on the 26th of each month if there was no payment received? The Village attorney stated that the Village can pull meters for non-payment after the 10th day after receiving their disconnect notice. Siecke stated that we need to put a notice on September utility bill that there will be NO extensions granted. 3. Water & Sewer: Monthly Report-Water loss 63.18%. Bid for large water meters is $3,375.00 without the cost of the pit. The board wants two of them to install on the north and south sides of town to see if we can locate the water leaks. Siecke asked Larry McCullock (Maintenance supervisor) to check prices of the regular water meters. $133.33 each for basement water meters and $146.67 for pit meters to finish replacing the old ones. Troutman stated that he asked the maintenance crew to check manholes again and they were running normal. The main guy from Johnson Service was here and stated they would be here in a month to camera the rest of the manholes. 4. Parks: Income of $11,666.16. 5. Streets Monthly Report- Sales Tax $12,453.64-1/2 to LB840, Highway Allocation-$8,573.38, Highway Allocation for August $7,292.37. Warren stated that we need to start working on filling cracks in the streets. Siecke stated that he had talked with Larry about getting this done either this month or the first part of September. Klatt stated he will follow up with Larry. Siecke has had some phone calls from people on Riverview complimenting the work on the street. 6. Sears Center- Email from Judy Connealy in regards to new windows at Sears Center. A) Quote for Maintenance on Dry Sprinkler System. The quote is $1,620.00 to perform five-year maintenance on dry fire sprinkler system, replace two gauges at the fire sprinkler riser, perform intern inspection of check valves. Perform three-year air leakage test on dry sprinkler system. Warren made a motion to sign the contract with Johnson Fire Control for inspection. Troutman seconded the motion. Roll Call: Hightree-yes, Klatt-yes, Siecke-yes, Warren-yes, Troutman-yes. 6) OLD BUSINESS: 1. Misti Hardeman-Basketball Court at North Park. Misti Hardeman came to the table with Harlie Nolze, Rusty Hardeman to discuss where the basketball court was going to be placed at North Park. Hightree made a motion to allow the basketball court to constructed at North Park with the area to be determined. Klatt seconded the motion. Roll Call: Siecke-yes, Troutman-yes, Warren-yes, Hightree-yes, Klatt-yes. Siecke suggested moving the Bill Phelps plaque to the new basketball court. 2. Planning Commission Recommendations-Update Ordinance to match Zoning. ORDINANCE NO. 08-12-2021-2 AN ORDINANCE APPLYING TO THE VILLAGE’S EXTRATERRITORIAL ZONING JURISDICTION ANY AND ALL BUILDING PERMIT AND OTHER BUILDING REGULATIONS APPLICABLE WITHIN THE VILLAGE’S CORPORATE LIMITS; DECLARING ANY BUILDING OR STRUCTURE ERECTED, CONSTRUCTED, REPAIRED, ENLARGED, DEMOLISHED, OR RELOCATED IN SAID ZONE WITHOUT A PERMIT OR OTHERWISE IN VIOLATION OF ANY BUILDING REGULATION APPLICABLE WITHIN THE CORPORATE LIMITS A PUBLIC NUISANCE; PROVIDING A PENALTY; REPEALING CONFLICTING ORDINANCES AND SECTIONS; PROVIDING AN EFFECTIVE DATE. WHEREAS the Village may apply by ordinance any property use regulations and building ordinances to the unincorporated area one mile beyond and adjacent to its corporate boundaries, pursuant to Neb. Rev. Stat. § 17-1001; NOW, THEREFORE, BE IT ORDAINED BY THE CHAIRPERSON AND BOARD OF TRUSTEES OF THE VILLAGE OF DECATUR, NEBRASKA: SECTION 1. Any building permit required and any building regulation applicable within the corporate limits of the Village shall be and hereby is in all respects made applicable to the unincorporated area one mile beyond and adjacent to the Village’s corporate boundaries, as identified on the map entitled, “The Official Zoning Map of the Village of Decatur, Nebraska,” to include all Code sections contained within Title XV, Chapter 150 of the Village’s Code. SECTION 2. Any building or structure erected, constructed, repaired, enlarged, demolished, or relocated within the unincorporated area one mile beyond and adjacent to the Village’s corporate boundaries without a permit or otherwise in violation of any building regulation applicable within the Village’s corporate limits shall be and hereby is deemed and considered to be a public nuisance and may be abated by the Village at the expense of the owner. SECTION 3. Any person violating this Ordinance or any provision of Title XV, Chapter 150 of the Village’s Code within the unincorporated area one mile beyond and adjacent to the Village’s corporate boundaries shall be guilty of an offense, the penalty for which is provided generally in the Village’s Code, at § 10.99. SECTION 4. Any other ordinance or Code section passed and approved prior to the passage, approval, and publication or posting of this Ordinance and in conflict with its provisions is hereby repealed. SECTION 5. This Ordinance shall take effect and be in full force from and after its passage, approval, and publication or posting as required by law. Hightree made a motion to pay Coughlin $5,000.00. Motion died due to no motion to second. Warren made a motion to pay Coughlin $4,105.00 with the stipulation that it is paid to Sta-built, with confirmation to the Village of payment. Klatt seconded the motion. Roll Call: Hightree-yes, Troutman-yes, Siecke-yes, Warren-yes, Klatt-yes 7) NEW BUSINESS: 1. Resolution #160 Allowing Alcohol in Designated Areas at Beck & Busse-Brewer Memorial Park. RESOLUTION NO. #160 A RESOLUTION OF THE VILLAGE OF DECATUR, NEBRASKA, PERMITTING THE USE OF ALCOHOLIC BEVERAGES WITHIN BECK & BUSSE-BREWER MEMORIAL PARK; REPEALING CONFLICTING RESOLUTIONS; PROVIDING AN EFFECTIVE DATE. WHEREAS Village Code section 90.09 provides, “It shall be unlawful for any person to introduce, possess or consume any intoxicating liquors in any park, playground, campground, ballfield or public property area owned or operated by the village except in such areas as may be designated by resolution of the Village Board.” NOW, THEREFORE, BE IT RESOLVED by the Board of Trustees of the Village of Decatur, Nebraska: Section 1. Alcoholic beverages may be possessed and consumed within Beck & Busse-Brewer Memorial Park by any person otherwise lawfully able to possess and consume them. Section 2. Any and all resolutions conflicting herewith shall be and hereby are repealed. Section 3. This Resolution shall become effective immediately upon its passage and approval. ORDINANCE NO. 08-12-2021 AN ORDINANCE PROHIBITING SOLICITATION, PEDDLING, HAWKING, AND SALES WITHIN BECK & BUSSE-BREWER MEMORIAL PARK; PROVIDING A PENALTY; REPEALING CONFLICTING ORDINANCES AND SECTIONS; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CHAIRPERSON AND BOARD OF TRUSTEES OF THE VILLAGE OF DECATUR, NEBRASKA: SECTION 1. Notwithstanding any other ordinance or section of the Village’s municipal Code, it shall be unlawful for any person to solicit, peddle, hawk, or to offer, sample, or sell any goods, services, or thing at any time within Beck & Busse-Brewer Memorial Park. SECTION 2. Any violation of this Ordinance shall be punished as provided generally in the Village’s municipal Code, at § 10.99. SECTION 3. Any other ordinance or Code section passed and approved prior to the passage, approval, and publication or posting of this Ordinance and in conflict with its provisions is hereby repealed. SECTION 4. There was no discussion from the board. 4. Chris Wanamaker-Discuss enforcement of ALL City Park “Rules” i.e., “Alcohol Prohibited” Chris Wanamaker did not attend the meeting. There was no discussion from the board. 5. Tim Slaughter, Nick French and Rick Huffman-Planning Commission Candidates. Therese Magill is resigning from the Planning Commission and we have two open positions on the Commission. Klatt made a motion to appoint Tim Slaughter, Nick French and Rick Huffman to the Planning Commission. Troutman seconded the motion. Roll Call: Warren-yes, Hightree-yes, Siecke-yes, Klatt-yes, Troutman-yes. 6. Tim Slaughter-Riverview Covenant. Tim came to the table to talk about the Riverview Covenant. According to the Village attorney the Village does not enforce covenants. The Residents in the addition would have to form a Home Owners Association. Slaughter is concerned about the Village not getting tax money for new homes that could possibly be built. Siecke stated that the zoning book needs updated, and the board members have spoke with the Planning Commission members about making recommendations to the board. 7. Garbage Bids. Carrier container and King Disposal were present with their bids for garbage pickup. King disposal proposed $19.00 per household with a four-year contract. Carrier Containers bid was $21.00 per household with a five-year contract. Brummond Disposal asked for an extension on the bid. Troutman made a motion to table garbage bids until the September 9, 2021 meeting. Klatt seconded the motion. Roll Call: Hightree-yes, Siecke-yes, Warren-yes, Troutman-yes, Klatt-yes. 8. 2022 Waste, Litter, and Scrap Tire Grant Application. The board decided to apply for scrap tire grant. 9. Employee Health Insurance BlueCross BlueShield only raised $159.93 for four employees. Hightree made a motion to stay with BlueCross BlueShield from Burt County Insurance for the employee health insurance. Warren seconded the motion. Roll Call: Troutman-yes, Siecke-yes, Klatt-yes, Hightree-yes, Warren-yes. 10. Discuss 2021-2022 Budget. 11. The board discussed the figures that were sent to Williams & Company. 12. Bush Hog for the skid loader, Tires for White Dually. D & M Repair submitted a bid for four tires for the white dually truck in the amount of $1,349.88. Warren made a motion to purchase the tires from D & M Repair for $1,349.88 for the white dually truck. Troutman seconded the motion. Roll Call: Hightree-yes, Klatt-yes, Siecke-yes, Warren-yes, Troutman-yes. The board asked that Larry get three bids for the bush hog. 13. Bid for Structural Integrity of City Hall. There was much discussion on the structure of the City Hall. The bricks are falling off the building and the building is leaking. The board does not want to put a lot of money into the building if the structural integrity is not good. Klatt is concerned that there is nothing wrong with the structural integrity, he feels that the Village is wasting the money that could be used to do repairs. Hightree just wants to make sure that the building is in good enough condition to spend the money for repairs that need to be done. Hightree made a motion to accept the $3,600.00 bid from RO Youker to inspect City Hall. Warren seconded the motion. Roll Call: Klatt-yes, Troutman-yes, Siecke-yes, Hightree-yes, Warren-yes. 14. 1977 Basket Truck to Lee Valley Farm Sale. The board would like to have a $3,500.00 reserve on the truck. Klatt made a motion to take the 1977 Basket Truck to the Lee Valley sale on August 19, 2021 with a reserve limit of $3,500.00. Hightree seconded the motion. Roll Call: Warren-yes, Troutman-yes, Siecke-yes, Klatt-yes, Hightree-yes. 15. Quote for Maintenance on Dry Sprinkler System. Perform three-year air leakage test on dry sprinkler system. The board tabled this item until we have our report from the structural engineer. 8) CORRESPONDENCE AND ANNOUNCEMENTS: 1. Next Regular Board Meeting will be September 9th, 2021 at 4:30 P.M. 2. Letting of Bids for the Work on Highway 51 is August 26, 2021. The Village board is interested in the bid acceptance. They want to get a street wish list together and possibly get a bid from whomever is doing the Highway 51 project. 3. Information for water reservoir cleaning. Reservoir was cleaned in 2018. This is required every five years. 4. Are there any questions or comments from the audience?
